Former Spurs Team Psychologist Makes Decision On Lawsuit Against Guard Josh Primo

Dr. Hillary Cauthen, a performance psychologist who was previously employed by the San Antonio Spurs, has made a decision regarding her lawsuit against guard Josh Primo. According to KSAT, Cauthen has opted to bring an end to the matter out of court.

Primo became the subject of a lawsuit in early November. Cauthen made a filing accusing the player of exposing himself to her. According to her statements, this occurred on nine different occasions during their private sessions. She subsequently agreed to settle a lawsuit filed against the Spurs organization.

Cauthen claimed in her suit that the team had been informed of the incidents and failed to take any action. Primo was selected as the 12th overall pick in last year’s NBA Draft.

She also alleged that the team lessened her involvement after she spoke out on the issue. Cauthen did not renew her contract when it expired at the end of August. She also refused to levy any punishment against the 19-year-old.

The Lawsuit Gets Dropped On Josh Primo

The psychologist has since decided to drop the suit against Josh Primo. Tony Buzbee indicates the parties have come to terms over the suit, despite public scrutiny.

“The parties have agreed to resolve the matter,” an email to KSAT reads.

Primo, though, has been waived by the Spurs and, while he remains the subject of many teams’ interest around the league, there’s little in the way of action as it pertains to putting things in place to sign him.

Josh Primo Attorney’s Statement On The Lawsuit

The player’s attorney has shared a statement in the wake of Cauthen’s decision not to take action. 

“Josh Primo is a 19-year-old NBA player who has suffered a lifetime of trauma and challenges. He is now being victimized by his former team-appointed sports psychologist, who is playing to ugly stereotypes and racially charged fears for her own financial benefit,” it reads.

“In an act of betrayal against her young client, Dr. Cauthen, who is 40 years old, falsely claims Josh Primo exposed himself to her during the course of her numerous therapy sessions. Dr. Cauthen’s allegations are either a complete fabrication, a gross embellishment, or utter fantasy. Josh Primo never intentionally exposed himself to her or anyone else and was not even aware that his private parts were visible outside of his workout shorts.

Primo and His Team Believe The Source Is Uncredible

‘What makes the allegations even less credible is that Dr. Cauthen never informed her patient of the purported exposure. Dr. Cauthen was Mr. Primo’s mental health support provider and confidant; a therapist who Mr. Primo trusted. She is much older than Mr. Primo, with many years of experience as a sports psychologist. It is baffling why she did not bother to tell her patient that his private parts were visible underneath his shorts.

“Josh Primo is at the beginning of a promising career and has been devastated by these false allegations and release by the Spurs. He is in the process [of] seeking treatment to deal with the trauma inflicted on him by Dr. Cauthen’s misleading allegations, in addition to the previous trauma he suffered as a child. He looks forward to clearing his name and to moving forward with his NBA career.”

The Spurs Begin To Struggle

Meanwhile, the Spurs have been on a slide following their surprise 5-2 start to the 2022/23 season. They will face a stern test as they close out the year with a game against the Phoenix Suns. This game will take place on December 4th. This game sticks out as one of interest given how strong the Suns have been over the past three terms. San Antonio suffered a blowout loss to the New Orleans Pelicans on Wednesday night. As mentioned above, they got off to a good start to the current campaign and the offense looked pretty solid. The Spurs’ Respond to The Incident

The team also did address the situation with Primo. CEO RC Buford had a statement published last week indicating how seriously the Spurs have treated the allegations.

“The situation regarding Josh Primo is a matter we take seriously,” he remarked. “Since learning of the allegations, we have taken, and are taking, measures to ensure that all parties involved are treated with dignity and respect. We know we owe that to Dr. Cauthen, our players, our staff, and our community.”

“As an organization, we are continuously evaluating and refining our processes so they ultimately reflect the values and culture of who we aspire to be every day. To that end, we have decided to collaborate with Dr. Cauthen and other experts in an effort to review and improve our workplace processes and procedures. This is a learning opportunity for us, and one that we are certain will make us better moving forward.”
